The website accessible via the domain names angelevl.be, angele.live, and angele.music (hereinafter the “Website”), its content and address are published and made available online by Saïmiri SRL (hereinafter “Saïmiri” or the “Data Controller”), whose registered office is located at chaussée d'Alsemberg 367, 1190 Forest, Belgium, registered with the Crossroads Bank for Enterprises (BCE) under number 0768.467.553.

The Website is hosted by Shopify. Its data centers are located within the European Economic Area, the United Kingdom, Switzerland, or another country that ensures an adequate level of data protection in accordance with the GDPR.

 

Saïmiri has adopted this Personal Data Processing Policy to provide Website users with transparent information regarding the manner in which their personal data is processed.

 

Saïmiri determines the technical, legal, and organizational means and purposes of processing Users’ personal data. Saïmiri undertakes to take all necessary measures to ensure that personal data is processed in accordance with:

·     the Belgian Act of July 30, 2018 on the protection of individuals with regard to the processing of personal data (the “Law”);

·     Regulation (EU) 2016/679 of April 26, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “Regulation”); and

·     Directive 2002/58/EC of July 12, 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (the “Directive”).

 

For the purposes of this Policy, the term “User” refers to any natural or legal person who visits or interacts in any way with the Website.

Processing necessary for the performance of the contract (Art. 6.1.b of the Regulation): the data is required for :

- order management and tracking;

- invoicing;

- delivery of orders;

- handling product information requests;

- management orders-related issues;

- Processing returns;

- Handling disputes relating to orders.

- Banking data: for the duration necessary to complete the transaction and process any refund following a withdrawal.

- IP address: 30 days;

- Other data: until expiry of the statutory limitation period applicable to contractual matters.

- Banking data and IP addresses may be retained for longer in the event of a dispute, until final resolution and exhaustion of all legal remedies.

 

 

3. Linked websites and third parties websites

 

The Website may contain links to pages or accounts belonging to Saïmiri or the artist Angèle on social media platforms (the “Linked Sites”). These links are provided for the User’s convenience. Linked Sites are not under the control of Saïmiri. Users access them voluntarily and at their own risk. Users are encouraged to consult the terms of use, privacy policy, and cookie policy of these Linked Sites.

 

A pop-up window may appear when a User accesses these Linked Sites without being logged in. However, Saïmiri does not control such mechanisms and provides this information for guidance only.

By clicking on these links, the User leaves the Website. Saïmiri declines all responsibility in this regard.

 

Users are strongly encouraged to properly configure their social media account settings, particularly regarding privacy and the processing of personal data.

4. Data r
ecipients and disclosure to third parties

      

Personal data may be communicated to employees and collaborators who are bound by a confidentiality obligation (see Article 6 below).

 

Saïmiri may appoint any natural or legal person to process personal data on its behalf (the “Processor”). Where applicable, Saïmiri undertakes to select its Processors carefully and to ensure that they provide sufficient guarantees of compliance with the Law, the Regulation, and the Directive.

 

Any transfer of personal data to a Processor is governed by a written agreement limiting the Processor’s use of the data to what is strictly necessary for the performance of the services and requiring appropriate security measures. However, Saïmiri cannot independently verify the actions or omissions of its Processors and cannot be held liable for them.

 

If personal data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance and may provide consent where required.

 

Personal data processed by Saïmiri may be stored on servers located outside the European Union and/or transferred outside the European Union in accordance with Articles 44 et seq. of the Regulation. Such transfers are based on an adequacy decision, appropriate safeguards under Articles 46 et seq. of the Regulation (including European Commission standard contractual clauses or binding corporate rules); or regulations recognized as providing an adequate level of protection.

 

5. User’s Rights

 

Users may exercise their rights at any time by sending an email to privacy [@] angele.music or by post, together with a copy of their identity card, to Saïmiri SRL, Chaussée d’Alsemberg 367, 1190 Forest, Belgium.

 

a. Right to withdraw consent

 

Where processing is based on consent, the User may withdraw consent at any time. This does not affect the lawfulness of processing carried out prior to withdrawal.


b. Right of access

 

Pursuant to Article 15 of the Regulation, Users have the right to access their personal data and obtain information regarding:

 

·     processing purposes;

·     categories of data concerned;

·     recipients or categories of recipients;

·     retention period or criteria used to determine it;

·     the existence of automated decision-making, including profiling, and meaningful information about the logic involved and its consequences.

 

Additional copies may be subject to reasonable administrative fees.

 

A copy of the data will be provided within one month of receipt of the request.


c. Right of rectification

 

Users may request correction of inaccurate or incomplete personal data (Article 16 of the Regulation).

 

The Data Controller will notify recipients of any rectification unless this proves impossible or involves disproportionate effort (Article 19 of the Regulation).

 

d. Right to erasure

 

Users may request erasure of their personal data in the cases provided for in Article 17 of the Regulation.

This right does not apply where processing is necessary for freedom of expression and information, compliance with a legal obligation, performance of a task in the public interest, establishment, exercise, or defense of legal claims.

Recipients will be informed of any erasure unless impossible or disproportionate (Article 19 of the Regulation).

 

e. Right to restriction of processing

 

Users may request restriction of processing in the cases provided for in Article 18 of the Regulation.

f. Right to data portability

 

Under Article 20 of the Regulation, Users may receive their personal data in a structured, commonly used, and machine-readable format and transmit it to another controller.

 

Where technically feasible, Users may request direct transmission between controllers.

 

This right does not apply to processing carried out in the public interest or under official authority and must not adversely affect the rights of third parties.

 

g. Right to object and automated individual decision-making

 

Users may object at any time to processing based on their particular situation. Saïmiri will cease processing unless compelling legitimate grounds override the User’s interests or processing is required for legal claims (Article 21 of the Regulation).

 

Users may object at any time to processing for direct marketing purposes, including profiling related to such marketing. In such cases, the personal data will no longer be processed for those purposes.

6. Security

 

Saïmiri implements organizational and technical measures to ensure an appropriate level of security for the Saïmiri implements appropriate technical and organizational measures to ensure a level of security appropriate to the risks associated with processing personal data, taking into account implementation costs and the nature, context, and purposes of processing.

 

Saïmiri uses standard encryption technologies when transferring or collecting data via the Website.

Internal security measures include:

·     confidentiality obligations for individuals with access to personal data.

 

Saïmiri cannot be held responsible for loss, corruption, or theft of personal data caused by viruses or cyberattacks. Saïmiri will notify the supervisory authority of any personal data breach within the time limits set out in Article 33 of the Regulation and inform affected Users in accordance with Article 34 of the Regulation.

 

7. Disclosure in case of violation

 

Saïmiri may disclose any information relating to a User (including identity) to public authorities where necessary in connection with a complaint or investigation concerning use of the Website in breach of applicable terms or legislation.

 

Saïmiri may retain all data and information communicated via the Website in accordance with this Policy.

Disclosure may also occur where necessary to identify or contact a person causing harm to the Website, Saïmiri, or third parties, or to initiate legal proceedings.

 

Saïmiri reserves the right to disclose any information required by law, court order, or public authority request, including exchanges of information for fraud prevention purposes, where legally permitted.

 

8. Amendments

 

Saïmiri reserves the right to modify this document at any time by publishing the modified version of the text on the Website, in particular in order to comply with legal obligations in this area. Users are therefore invited to consult this document regularly in order to be aware of any modifications and adaptations.

      

9. Governing law and  jurisdiction

      

This Policy is governed exclusively by Belgian law. Any dispute shall fall within the jurisdiction of the courts of the judicial district in which Saïmiri has its registered office.
